Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Kwame Poku ("we", "us") governing your use of Poth.OS ("the app"). By creating an account or using the app, you agree to these Terms. If you do not agree, do not use the app.

Eligibility

You must be at least 13 years old, or the minimum age required in your country to use the app without parental consent, whichever is higher, to create an account.

Not medical or therapeutic advice

Poth.OS is a companion app for plant care and personal reflection. It is not therapy, counselling, or medical care, and it does not diagnose or treat any condition. Plant-care guidance is general information, not horticultural advice for your specific plant, environment, or region.

Your license to use the app

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Poth.OS for your own personal, non-commercial use, subject to these Terms.

Your content

You keep ownership of what you write and upload. By submitting content to public surfaces (Wall posts, marketplace listings, your display name), you grant us a license to host and display it within the app as intended for that feature.

Community conduct

Do not harass others, post illegal or hateful material, spam, impersonate people, or evade blocks. We may remove content or suspend or terminate accounts to protect the community, with or without notice.

Marketplace

Poth.OS does not handle payment, vet sellers, ship items, or become a party to a transaction between users. Listings must be honest and limited to lawful plants and cuttings. Protected and invasive species may not be listed. You transact with other users at your own risk.

Subscriptions and billing

Pro subscriptions are billed and auto-renew through Google Play, and can be restored through the app. Cancel any time in your Google Play account settings — cancellation takes effect at the end of the current billing period. Refunds are governed by Google Play's policies, not by us directly.

Termination

You may stop using the app at any time and delete your account per our deletion policy. We may suspend or terminate your access if you violate these Terms. Provisions that by their nature should survive termination (ownership, disclaimers, limitation of liability, governing law) will survive.

Disclaimer of warranties

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the app will be uninterrupted, error-free, or that any care recommendation will be accurate for your specific plant.

Limitation of liability

To the maximum extent permitted by law, Kwame Poku will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the 12 months before the claim, or $50 USD.

Indemnification

You agree to indemnify and hold us harmless from any claim arising from your misuse of the app, your content, or your violation of these Terms or applicable law.

Governing law

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above; continuing to use the app after changes take effect means you accept the updated Terms.

Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the app.
